1. Who we are and how these terms apply
1.1 This website, projectlighting.co.za (the “Site”), is operated by Project Lighting (Pty) Ltd, Registration No. 2025/565960/07, trading as The Project Lighting & Design Group (“we”, “us”), a private company incorporated in South Africa, of Unit 7, No. 5 Section Street, Paarden Eiland, Cape Town, 7405. 1.2 By using the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site. We may change these terms at any time by posting the updated version on the Site; continued use after a change is acceptance of it.
1.3 The Site provides information about our lighting design, specification and supply services and our product ranges, and allows you to contact us and request quotations. Goods and services are supplied only under a quotation and our Standard Terms and Conditions of Sale, which apply to every order and prevail over these Terms of Use in the event of conflict.
2. Use of the Site
2.1 You may use the Site for lawful purposes only. You may not use the Site in any way that damages or interferes with it, attempt to gain unauthorised access to any part of the Site or its systems, introduce malicious code, scrape or harvest content or data, or use the Site to send unsolicited communications.
2.2 You may view, download and print pages from the Site for your personal or internal business use in evaluating our products and services. Any other use, including reproduction, modification, distribution or commercial exploitation of Site content, requires our prior written consent.
3. Intellectual property
3.1 The Site and all its content, including text, photographs, product images, lighting designs, drawings, specifications, catalogues, logos and trade marks, are owned by or licensed to us and are protected by copyright and other intellectual property laws. The Project Lighting name and logo are our trade marks. Product images and brand names of manufacturers appear with their permission and remain their property.
3.2 Lighting designs, specification documents and drawings we prepare for a project remain our property and are licensed to the client for that project only, as set out in our Standard Terms and Conditions of Sale.
4. Product information, prices and availability
4.1 Product information on the Site is provided for general guidance. Specifications, colours, light output, colour temperature, dimensions and finishes are indicative, may vary between batches within manufacturers' tolerances, and may change without notice as ranges are updated. Photographs may not exactly represent the product supplied.
4.2 Any prices shown on the Site are indicative, in South African Rand, and exclude VAT and, unless stated, delivery outside the Cape Town metropolitan area and installation. Prices, stock and lead times are confirmed only in a written quotation. The Site does not conclude sales: no contract is formed until we accept an order under our Standard Terms and Conditions of Sale.
4.3 We do not install products. Installation must be carried out by a qualified electrician in accordance with the manufacturer's instructions and applicable regulations. Dimming and control compatibility is not warranted unless confirmed by us in writing for a specific combination.
5. Enquiries and quotations
5.1 When you submit an enquiry or quotation request, you confirm that the information you provide is accurate and that you are authorised to provide it. We will use it to respond to you as described in our Privacy Policy. Submitting an enquiry does not create an obligation on either party until a quotation is accepted in writing.
6. Third-party links and content
6.1 The Site may contain links to manufacturers' websites, datasheets and other third-party content. We provide these for convenience and do not control or endorse them. We are not responsible for the content, availability or privacy practices of third-party sites.
7. Disclaimers and limitation of liability
7.1 The Site is provided “as is”. To the extent permitted by law we give no warranty that the Site will be uninterrupted, error-free or free of viruses, or that its content is complete, accurate or current.
7.2 To the extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Site or its content, or from reliance on information on the Site, including indirect, consequential or special loss. Nothing in these terms excludes liability that cannot be excluded under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
8. Privacy and cookies
8.1 We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 and our Privacy Policy, which forms part of these terms. The Site uses cookies and similar technologies as described in the Privacy Policy.
9. Electronic Communications and Transactions Act disclosures
9.1 In compliance with section 43 of the Electronic Communications and Transactions Act 25 of 2002: our full name and legal status is Project Lighting (Pty) Ltd, a private company registered in South Africa under number 2025/565960/07; our physical address is Unit 7, No. 5 Section Street, Paarden Eiland, Cape Town, 7405; our telephone number is 078 566 5974 and our email address is [email protected]; our website address is projectlighting.co.za; our directors are Robin Sherwin Smith, Crispin Inglis, Gregory Dean Young and Bernard Kleynhans; we are not currently registered for VAT (our VAT number will be published here on registration); the terms on which we supply goods and services are our Standard Terms and Conditions of Sale, available on request or with each quotation; and the manner and period within which you may access and maintain a record of any transaction is by retaining the quotation, order and invoice we send by email.
Warranty, returns and liability
Products carry the manufacturer's warranty stated on the quotation, running from invoice date and administered by us; it excludes labour, access equipment, and damage from incorrect installation or supply conditions outside the datasheet. Report short delivery or transit damage within 2 business days and dead-on-arrival units within 7 days of delivery, quoting the invoice number; confirmed faults are replaced or credited. Non-faulty stock items may be returned within 14 days by prior arrangement, unused and in original packaging, less a 15% restocking fee; special-order and imported-to-order items cannot be returned. Ownership of goods passes only on payment in full. Our liability for any order is limited to the price paid for the goods concerned and excludes consequential loss, except where the Consumer Protection Act provides otherwise for customers to whom it applies. Installation must be carried out by a registered electrician. These terms are governed by South African law. Project Lighting (Pty) Ltd, registration number 2025/565960/07. The company is not registered for VAT. Prices on a quotation do not include VAT. Full terms appear in our Standard Terms and Conditions of Sale.
10. General
10.1 These terms are governed by the laws of South Africa and the courts of the Western Cape have jurisdiction over any dispute. If any provision is unenforceable the remainder continues to apply. These terms, the Privacy Policy and (for any supply) our Standard Terms and Conditions of Sale are the whole agreement between you and us regarding the Site.
